When you file your CA state taxes ... you're supposed to fill out a line that asks if you bought items from out of state and didn't pay state tax on them... and then pay the tax.

When you file your CA state taxes ... you're supposed to fill out a line that asks if you bought items from out of state and didn't pay state tax on them... and then pay the tax.
If the independent seller is located in California and you are in California, they have to charge you sales tax.
The fact the item is used and somebody already paid sales tax is moot.
